THE REPRESENTATION OF THE PEOPLE (INTERIM ELECTORAL REFORM) (AMENDMENT) ACT 13 OF 1996

AN ACT to Amend the Representation of the People (Interim Electoral Reform) Act.

BE IT ENACTED by The Queen's Most Excellent Majesty, by and with the advice and consent of the Senate and House of Representatives of Jamaica, and by the authority of the A same as follows:-
1 Short title, construction on and commencement
(1) This Act may be cited as the Representation of the People (Interim Electoral Reform) (Amendment) Act, 1996 and shall be read and construed as one with the Representation of the People (Interim Electoral Reform) Act (hereinafter referred to as the principal Act) and all amendments thereto.
(2) The provisions of paragraph (c) of section 2 shall come into operation forthwith.
(3) The provisions of paragraphs (a), (b) and (d) of section 2 shall come into operation on a day to be appointed by the Minister by notice published in the Gazette.
2 Amendment of Schedule to principal Act
The Schedule to the principal Act is amended-
(a) in sub-paragraph (1) of paragraph 1-
(i) by deleting the word "eight" and substituting therefor the word "six";
(ii) by deleting from sub-paragraph (a) the words "two members" wherever they appear and substituting therefor in each cede the words "one member";
(b) by inserting next after sub-paragraph (1) the following as sub-paragraphs (1A) and (1B)-
" (1A) In relation to each of the nominated members, an additional member (in this Act referred to as an "alternate member") shall be appointed by the Governor-General, one on the advice of the Prime Minister and one on the advice of the Leader of the Opposition.
(1B) An alternate member may-
(a) attend meetings of the Committee and participate in its deliberations; and
(b) shall be eligible to vote at a meeting of the Committee only if the nominated member in relation to whom he is appointed is absent from that meeting.";
(c) by deleting sub-paragraph (1) of paragraph 3 and substituting there or the following-
" (1) Subject to the provisions of this Schedule, the appointment of-
(a) a nominated member of the Committee shall be for a period of eighteen months;
(b) a selected member of the Committee shall be for a period of four years;
(c) the Director of Elections shall be for a period of seven years.";
(d) by inserting next after paragraph 1 the following as paragraph 1A-
1A. "Application of other provisions of Schedule to alternate members.
Without prejudice to sub-paragraph (1B) (b) of paragraph 1, the provisions of paragraphs 2 and 3, sub-paragraphs (1) of paragraph 6 and paragraphs 10 and 11 shall apply in relation to an alternate member.".
